Terms of Service

These Terms of Service govern your use of the FABX Studio website and your purchase of products or services from us.

FABX Studio is operated by The Fab Lab Pte. Ltd., a company registered in Singapore. By accessing this website, submitting an order or purchasing from us, you agree to these Terms of Service together with our Return and Refund Policy, Shipping Policy and Privacy Policy.

1. Online Store Terms

You must provide accurate, complete and current information when placing an order, including your name, contact information, delivery address, product specifications and artwork details.

You may not use our website, products or services for any unlawful, fraudulent or unauthorised purpose.

We reserve the right to refuse or cancel an order where:

  • information supplied is incomplete or inaccurate;
  • payment cannot be verified;
  • the requested product, artwork or usage falls outside our service scope;
  • the order appears fraudulent or unlawful;
  • the artwork may infringe another party’s rights; or
  • we cannot reasonably fulfil the requested specifications or timeline.

Where we cancel a paid order before production begins, any applicable refund will be processed to the original payment method.

2. Product Information

We make reasonable efforts to describe and display our products accurately. However, photographs, illustrations, digital mock-ups and screen colours are provided for general reference.

The appearance of printed fabric may vary because of:

  • fabric colour, texture, weight and absorbency;
  • screen and device settings;
  • lighting conditions;
  • printing and finishing processes;
  • minor differences in placement, measurements or construction; and
  • reasonable textile-production tolerances.

Such reasonable variations do not automatically constitute a defect.

3. Custom and Made-to-Order Products

Most FABX Studio products are printed, customised or made specifically for each order.

The customer is responsible for confirming all relevant specifications, including:

  • product and size;
  • fabric;
  • quantity;
  • finishing;
  • packaging;
  • delivery information; and
  • final artwork.

Production begins only after the required payment, specifications and artwork approval have been received, unless otherwise agreed in writing.

Once production has begun, the order may not be cancelled, returned or changed for change-of-mind reasons. Any accepted change may incur additional charges and restart the estimated lead time.

4. Artwork and File Requirements

Customers must submit final, complete and print-ready artwork in the required file format and dimensions.

FABX Studio is not responsible for errors contained in customer-supplied artwork, including:

  • spelling or grammatical errors;
  • incorrect colours, dimensions or placement;
  • low-resolution images;
  • missing fonts or linked files;
  • incorrect logos, names or dates;
  • unintended borders or blank spaces; or
  • artwork submitted using the wrong template.

A design proof is provided to confirm placement and production interpretation. It is not a colour-accurate representation and does not constitute an artwork-editing or design service.

Production may proceed once the customer approves the proof or otherwise confirms the final artwork in writing.

5. Artwork Changes and Design Services

Unless expressly included in the order, our prices do not include artwork creation, redesign, illustration, retouching, resizing or layout adjustment.

Where a revised file is submitted after proof preparation has begun, we may:

  • restart the artwork-review process;
  • revise the estimated timeline; and
  • charge an additional artwork or design-adjustment fee.

We will not alter customer artwork without written instruction or approval.

6. Intellectual Property

Customers retain ownership of artwork they submit, subject to any rights belonging to third parties.

By submitting artwork, you confirm that:

  • you own the artwork or have permission to reproduce it;
  • its production will not infringe any copyright, trademark, privacy or other rights;
  • it does not contain unlawful, defamatory or prohibited material; and
  • you have obtained all licences or approvals required for its intended use.

You grant FABX Studio a limited licence to use, reproduce, resize and process the artwork solely as necessary to assess, produce, pack and fulfil your order.

You remain responsible for claims arising from artwork or content supplied by you.

FABX Studio’s website content, branding, photographs, product templates, written materials and original designs remain the property of FABX Studio or their respective owners and may not be copied, reproduced or commercially used without permission.

7. Prices and Payment

Prices are shown in Singapore dollars unless otherwise stated.

FABX Studio is not GST-registered. Prices are therefore not subject to GST unless otherwise indicated.

Payment must be completed according to the terms shown at checkout, on the quotation or on the invoice. Production slots and timelines are not secured until the required payment or approved purchase order has been received.

Corporate orders may be subject to separate written quotation, purchase-order and credit terms. Where a written quotation or invoice conflicts with these general terms, the order-specific written terms will apply.

8. Quotations

Unless otherwise stated, quotations are valid for the period specified on the quotation.

A quotation does not reserve production capacity, materials or delivery dates. Availability and timelines are confirmed only after the required payment or purchase order, final specifications and artwork approval have been received.

We may revise a quotation where the customer changes the quantity, specifications, artwork count, packaging, delivery requirements or project scope.

9. Production and Lead Times

All lead times are estimates rather than guaranteed delivery dates unless we expressly agree otherwise in writing.

Lead time begins only after all required conditions have been completed, which may include:

  • payment or approved purchase order;
  • final specifications;
  • accessible, print-ready artwork; and
  • written artwork approval.

Delays caused by incomplete information, revised artwork, late approvals, address issues or customer-requested changes may extend the timeline.

FABX Studio’s internal workflow similarly treats payment and final artwork confirmation as necessary before an order moves into production.

10. Delivery

Customers are responsible for providing a complete and accurate delivery address and ensuring that someone can receive the order where required.

We are not responsible for delays or failed delivery caused by:

  • an incorrect or incomplete address;
  • an unavailable recipient;
  • courier restrictions;
  • customs or import procedures;
  • weather, transport disruption or events outside our reasonable control; or
  • instructions provided directly by the customer to the courier.

Additional delivery, redelivery, storage, customs, duties or import charges may be payable by the customer.

Risk of loss or damage passes to the customer upon successful delivery, except where applicable law provides otherwise.

11. Inspection and Order Issues

Customers should inspect their order promptly after delivery.

Where an item is damaged, defective or materially different from the confirmed specifications, contact us with the order number, a description of the issue and clear photographs.

Do not dispose of the product or packaging before the matter has been assessed.

Available remedies will depend on the circumstances and may include repair, replacement, price adjustment or refund, subject to our Return and Refund Policy and applicable Singapore law.

12. Samples and Test Prints

Swatches, samples and test prints are provided as references to assist with fabric, colour and print decisions.

A sample does not guarantee that bulk production will be completely identical. Minor differences may occur between batches because of fabric and production variables.

Where precise colour matching is important, customers should order a test print before approving bulk production.

13. Website Availability and Accuracy

We may update, suspend or discontinue any part of the website, product range or service without prior notice.

We may correct typographical errors, pricing errors, inaccurate descriptions or omissions. Where an error materially affects an order already placed, we will contact the customer before proceeding.

Product availability, fabric stock and production capacity may change without notice.

14. Third-Party Services

Our website may use or link to services operated by third parties, including Shopify, payment providers, shipping companies and external websites.

Their services are governed by their own terms and privacy policies. FABX Studio is not responsible for the content, availability or conduct of independent third-party services.

15. Limitation of Liability

To the fullest extent permitted by law, FABX Studio will not be liable for indirect, incidental, special or consequential loss arising from the use of our website or products, including loss of profit, revenue, opportunity, data or goodwill.

Where liability cannot lawfully be excluded, our liability will be limited to the remedies and amounts permitted by applicable law.

Nothing in these Terms excludes or limits rights or remedies that cannot legally be excluded under Singapore law.

Singapore’s Consumer Protection (Fair Trading) Act provides consumers with remedies concerning unfair practices and goods that do not conform to contract.

16. Indemnity

You agree to be responsible for claims, losses or expenses arising from:

  • artwork or materials supplied by you;
  • your infringement of another party’s intellectual-property rights;
  • your unlawful use of the website or products; or
  • your breach of these Terms.

This provision applies only to the extent permitted by law.

17. Force Majeure

We will not be responsible for delay or failure caused by events outside our reasonable control, including natural disasters, severe weather, fire, epidemic, government restrictions, labour disruption, transport interruption, customs delays, supplier disruption, internet failure or courier disruption.

Where such an event occurs, we may revise the production or delivery timeline or cancel the affected portion of an order and provide an appropriate refund for goods not supplied.

18. Changes to These Terms

We may revise these Terms of Service periodically. The version published on our website at the time an order is placed will generally apply to that order, together with any order-specific written quotation or agreement.

19. Governing Law

These Terms are governed by the laws of Singapore.

Any dispute arising from these Terms, our website or an order will be subject to the jurisdiction of the Singapore courts, unless the parties agree to another dispute-resolution process.
